1. Who we are

This website (northminimal.com) is operated by North Minimal, a company registered in Denmark under CVR no. 41742305. You can contact us at hello@northminimal.com.

Throughout these Terms of Service, "we," "us," and "our" refer to North Minimal, and "you," "your," and "Customer" refer to the user or purchaser.

2. Acceptance of terms

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by these Terms of Service ("Terms"), including any additional terms, conditions, and policies referenced here or available by hyperlink (including our Privacy Policy, Shipping & Returns Policy, and Refund Policy).

Please read these Terms carefully before using the site. If you do not agree with any part of these Terms, you may not access the website or use our services.

Any new features or tools added to the store are also subject to these Terms. We may update these Terms at any time by posting changes to this page. Your continued use of the site after changes are posted constitutes your acceptance of those changes. We recommend checking this page periodically.

3. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order on this site. By using the Service, you represent that you meet this requirement, or that you are using the site under the supervision of a parent or legal guardian.

4. Products, pricing, and errors

North Minimal shall have no liability in the event products are sold out, nor for image or typographical errors on the website (e.g., errors in product descriptions, technical specifications, inaccurate prices, or incorrect stock information). We are entitled to correct any such errors at any time.

If an inaccurate price is displayed for a product you have ordered, we will notify you before proceeding and will await your approval of the corrected price before continuing with the order. All product images are illustrations only and do not guarantee an exact reproduction of the product's appearance (e.g., colour may vary slightly by screen and print process).

Prices are displayed in the currency you select while browsing the site and are converted at checkout based on your chosen currency and/or shipping destination. All prices include applicable VAT unless stated otherwise; the VAT rate shown may vary depending on your delivery country, in accordance with applicable tax law. We reserve the right to limit sales of any product or Service to any person, geographic region, or jurisdiction, at our discretion.

5. Purchases and payment

To purchase a product or service ("Purchase"), you may be asked to provide certain information, including your payment details, billing address, and shipping information.

You represent and warrant that: (i) you have the legal right to use any payment method provided in connection with a Purchase, and (ii) the information you supply is true, correct, and complete.

By submitting this information, you grant us the right to share it with third parties (such as our payment processor and fulfilment partner) solely for the purpose of completing your Purchase. See our Privacy Policy for details on how we handle your data.

We accept the payment methods displayed at checkout. Your order is not confirmed until payment has been successfully processed.

6. Intellectual property

All content on this website — including but not limited to poster designs, photographs, artwork, product images, text, logos, and the overall look and feel of the site — is the original work of North Minimal and is protected by Danish and international copyright, trademark, and design law, unless otherwise stated.

You agree not to reproduce, duplicate, copy, sell, resell, redistribute, or otherwise exploit any content or design from this website, or the Service itself, for any commercial or public purpose without our express prior written permission. Purchasing a physical print does not transfer any copyright, reproduction right, or other intellectual property right in the design — you receive the physical product only, for personal, non-commercial use, unless we have agreed otherwise in writing.

7. Right of withdrawal (14-day cancellation right)

As a consumer within the EU, you generally have the right to cancel your order within 14 days of receiving your goods, without giving a reason, in accordance with the EU Consumer Rights Directive and the Danish Consumer Contracts Act (forbrugeraftaleloven).

Exception for made-to-order items: [Confirm with legal counsel] Because our posters, prints, and other items are produced specifically for you after you place your order (print-on-demand), they may qualify as goods "made to the consumer's specifications" or "clearly personalised" under Article 16(c) of the EU Consumer Rights Directive, which is an exception to the right of withdrawal. If this exception applies to a product, this will be clearly stated on the relevant product page before you complete your purchase.

For any items that are not exempt, you may cancel by contacting us at hello@northminimal.com within 14 days of delivery. You will then have a further 14 days to return the goods. Return shipping costs are your responsibility unless the item is faulty. Refunds are issued to your original payment method within 14 days of us receiving the returned goods (or proof of return shipment), in accordance with statutory requirements.

This section does not affect your statutory rights regarding faulty, damaged, or incorrect goods — see Section 8.

8. Warranty, faulty goods, and complaints

Regardless of the withdrawal right above, all goods purchased from North Minimal are covered by the Danish Sale of Goods Act (købeloven), which gives you the right to complain about defects for up to 24 months from delivery. If a product arrives damaged, defective, or not as described, contact us at hello@northminimal.com with your order number and photos of the issue, and we will arrange a repair, replacement, or refund in accordance with Danish law.

9. Third-party tools and services

We may provide access to third-party tools (such as payment processors, fulfilment partners, or shipping carriers) over which we have no control. We provide access to such tools "as is" and "as available," without warranties of any kind, and we accept no liability arising from your use of them. Use of any optional third-party tool is at your own risk, and you should review that provider's own terms.

10. Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so may result in immediate termination of your account.

You are responsible for keeping your login details confidential and must notify us immediately at hello@northminimal.com if you suspect unauthorised access to your account. You are responsible for all purchases made using your login details until you notify us of unauthorised use.

If we suspect misuse of an account or a violation of these Terms, we may suspend or block access to that account and issue new login credentials.

11. Prohibited uses

In addition to other restrictions in these Terms, you agree not to use the site or Service: to violate any applicable law or regulation; to infringe our intellectual property rights or those of others; to transmit malicious code, spam, or unauthorised advertising; to collect or harvest personal data of other users; or to interfere with the security or proper functioning of the site.

12. Privacy and data protection

Our collection and use of your personal data is governed by our Privacy Policy, available at https://www.northminimal.com/policies/privacy-policy, which is incorporated into these Terms by reference. We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable Danish data protection law.

13. Limitation of liability

To the maximum extent permitted by applicable law, North Minimal shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Service or any products purchased through it. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under Danish law, including liability for death, personal injury caused by negligence, or fraud.

14. Indemnification

You agree to indemnify and hold North Minimal, its owners, and employees harmless from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your violation of any law or the rights of a third party.

15. Force majeure

North Minimal is not liable for delays caused by circumstances beyond our reasonable control, including but not limited to labour disputes, extreme weather, acts of war, fire, terrorist attacks, changes in government orders, technical failures, or delays caused by sub-suppliers (such as our print-on-demand or shipping partners) due to the above. We will inform you of such a situation at its start and end. If the situation lasts more than two months, either party may cancel the order with immediate effect.

16. Governing law and jurisdiction

These Terms are governed by the laws of Denmark, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the Danish courts, specifically the courts of Copenhagen, unless mandatory consumer protection law in your country of residence grants you the right to bring proceedings in your local courts.

17. Online dispute resolution and complaints

If you are an EU consumer and have a complaint you cannot resolve with us directly, you may use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. You may also contact the Danish Center for Complaint Resolution (Center for Klageløsning) or the Danish Competition and Consumer Authority (Konkurrence- og Forbrugerstyrelsen) for guidance.

18. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

19. Entire agreement

These Terms, together with any policies referenced herein, constitute the entire agreement between you and North Minimal regarding the Service, and supersede any prior agreements or understandings.

20. Changes to these Terms

We reserve the right to update, change, or replace any part of these Terms by posting updates to this page. It is your responsibility to check this page periodically. Continued use of the site after changes are posted constitutes acceptance of the revised Terms.
